An individual planning to enroll in a nursing program may be ineligible for licensure as a Registered Nurse following graduation.

Eligibility to Write the National Council Licensure Examination for Registered Nurses (NCLEX RN)—Declaratory Orders

The Board of Nurse Examiners (BNE) for the State of Texas has set out guidelines and criteria on the eligibility of persons with criminal convictions to obtain a license as a registered nurse. The BNE may refuse to admit persons to its licensure examinations, may refuse to issue a license or certificate of registration, or may refuse to issue a temporary permit to any individual who has:

  • been convicted, adjudged guilty by a court, plead guilty, no contest or nolo contendere to any crime in any state, territory or country, whether or not a sentence was imposed;
  • any pending criminal charges or unresolved arrests (excluding minor traffic violations);
  • any expunged offenses and deferred adjudications with or without prejudice of guilt;
  • had any licensing authority refuse to issue a license or the licensing authority has ever revoked, annulled, cancelled, or the licensing authority accepted surrender of, suspended, placed on probation, refused to renew a professional license or certificate held by the individual, now or previously, or if the licensing authority has ever fined, censured, reprimanded or otherwise disciplined that individual;
  • in the past 5 years, been addicted to and/or treated for the use of alcohol or any other drug;
  • in the past 5 years, been diagnosed with, treated, or hospitalized for schizophrenia and/or psychotic disorders, bipolar disorder, paranoid personality disorder, antisocial personality disorder, or borderline personality disorder;
  • DUIs, DWIs, or PIs these are not minor traffic violations, and must be reported to the BNE;
  • two or more minor in consumption (MIC) or two or more minor in possession (MIP).

If you have reason to believe you may be ineligible for licensure, you may petition the Board of Nurse Examiners for a Declaratory Order as to your eligibility, in advance of School of Nursing program enrollment.
