Chapter 2 Student Conduct and Discipline
Subchapter 2-400 Initiation of Disciplinary Charges
  1. The Dean of Students Office will investigate allegations that a student has engaged in conduct that violates the Regents Rules and Regulations, University rules and regulations, instructions given by an administrative officer of the University or the U. T. System in the course of his/her duties, or a federal, state, or local law or regulation. The investigation and disciplinary action may proceed regardless of whether action is taken by other authorities. The Dean of Students Office may summon the student as provided in Section 2-402 for a conference, and after meeting with the student, either

    1. dismiss the allegations, or
    2. proceed administratively under Section 2-403, or
    3. proceed with notice and hearing under Subchapter 2-500.
  2. Pending disposition of the allegations, the Dean of Students Office may take immediate interim disciplinary action, including prohibiting the student from attending classes and from being in or on a University Facility if it reasonably appears from the circumstances that the continuing presence of the student presents a danger to persons or property or an ongoing threat of disruption of an authorized program or activity of the University. Other interim action may include withholding of grades, degree, or official transcript when such action is in the best interest of the University.
  3. When interim disciplinary action is imposed, the student is entitled to administrative disposition of the allegations under Section 2-403 or a hearing before a Hearing Officer under Subchapter 2-500 within 10 days after the interim disciplinary action is imposed, unless a later date is requested by or agreed to by the student and the Dean of Students Office.

  1. The Dean of Students Office may summon a student for the purpose of discussing allegations that the student has engaged in conduct that may result in disciplinary action. The summons letter will direct the student to make an appointment by a specified deadline at least three weekdays after the date of the letter and will be mailed to the student at the address appearing in the Registrar's records or may be hand delivered to the student.
  2. If a student fails to appear without a valid reason, the Dean of Students Office may bar or cancel the student's enrollment until the student appears or responds to the summons or may proceed with hearing procedures in the absence of the student.
  3. The failure of the student to maintain a current address with the Registrar, or to provide the postal authorities with a forwarding address, or to refuse to accept a registered or certified letter shall not be a valid reason for failure to comply with a summons letter.

  1. If a student does not dispute the alleged facts upon which the conduct violations are based and executes a written waiver of the hearing procedures under Subchapter 2-500, the Dean of Students Office will assess a penalty(ies) pursuant to Subchapter 2-300 that is/are appropriate to the facts and inform the student in writing.
  2. The student may appeal the penalty assessed by the Dean of Students Office under Section 2-403 in the same manner as a decision rendered pursuant to a hearing under Subchapter 2-500. The appeal is limited to the issue of the penalty and no transcript is required.

  1. A faculty member who believes that a student has engaged in scholastic dishonesty in a course taught by said faculty member will initiate and follow Form 1 or Form 2 procedures in accordance with Sec. 2-302(I) or 2-302(J).
  2. Faculty members are authorized to take the following actions after meeting with students or referring them to the Dean of Students Office for adjudication:

    1. If the student does not dispute the facts upon which the allegation of scholastic dishonesty is based and executes a written waiver of the hearing procedures under Subchapter 2-600, the faculty member may assess an academic penalty and recommend a disciplinary penalty (ies) to the Dean of Students Office (form 1 process);
    2. If the student disputes the facts upon which the allegation of scholastic dishonesty is based, the faculty member will refer the matter to the Dean of Students Office for processing under Sec. 2-402 (form 2 process) and issue an incomplete grade until the matter is adjudicated by the Dean of Students Office.
  3. The student may appeal the penalty assessed under Section 2-404 in the same manner as a decision rendered pursuant to Sec. 2-403. The appeal is limited to the issue of penalty and no transcript is required.
