Chapter 3 Student Organizations
Subchapter 3-700 Discipline of Student Organizations
- When the Vice President for Student Affairs or delegate receives information that a registered student organization has allegedly violated Regents' Rules and Regulations, University regulation, administrative order, or federal, state or local law or regulation, he/she shall ensure that the alleged violation is investigated.
- If an organization violates the Regents' Rules and Regulations, University regulation, administrative order, or federal, state or local law or regulation, it is subject to disciplinary action.
- A registered student organization violates the Regents' Rules and Regulations, University regulation, administrative order, or federal, state or local law or regulation when
- one or more officers acting in the scope of his/her general responsibilities commits the violation.
- one or more members commits the violation after the action that constitutes the violation was approved by majority vote of members present and voting.
- one or more members of a committee of the organization commits the violation while acting in the scope of the committee's assignment.
- a majority of the members of the organization acting with apparent authority of the organization commit the violation.
- one or more members of the organization or its officers permit, encourage, aid or assist any of its members in a violation.
- one or more members of the organization or its officers, under circumstances where such persons knew or should have known that an action constituting a violation was occurring or about to occur, fail to prevent such action.
- one or more members of the organization fail to promptly report to appropriate University or civil authorities their knowledge of any reasonable information about a violation.
- A student may be disciplined personally under Chapter 2 for a violation of the Regents' Rules and Regulations, University regulations, administrative order, or federal, state or local law or regulation even though the registered student organization of which he/she is a member is disciplined under this subchapter for the same violation or for a violation developing from the same conduct.
- Before the Committee on Student Organizations conducts a hearing on an alleged violation, it must notify a registered student organization in writing of the date, time, and place for the hearing. The Committee shall send the letter by certified mail, return receipt requested, to an officer of the registered student organization.
- The letter shall specify a hearing date at least 10 days after the date of the letter and shall direct the president of the registered student organization or his/her representative to appear at the hearing.
- The letter shall
- describe the alleged violation and
- advise the registered student organization of its right
- to a private hearing.
- to know the identity of each witness who will testify against it.
- to appear at the hearing with a representative or advisor or both.
- to offer testimony of witnesses, and documentary and other evidence in its own behalf.
- to cross-examine each witness who testifies against it.
- to have the hearing recorded and have a copy of the recording in the case of an appeal.
- to appeal as stipulated by Section 3-705.
- The Chair of the Committee on Student Organizations shall preside.
- The hearing is informal and private.
- A registered student organization does not have a privilege against self-incrimination; nor may it disqualify any members of the Committee by challenging either peremptorily or for cause.
- The Vice President for Student Affairs shall furnish the Committee with a suitable room and necessary equipment for a hearing.
- To the extent consistent with this chapter, the Committee shall follow the procedures set forth in Chapter 2-600.
If the Committee on Student Organizations, after conducting a hearing, finds that a registered student organization has violated the Regents'
Rules and Regulations, University regulation, administrative order, or a federal, state or local law or regulation, the Committee may
- suspend the organization's privilege to publicly post signs, set up a booth, publicly assemble or demonstrate in the name of the organization, present activities, publicly raise funds, reserve the use of University Facilities, or participate in recreational sports for not more than one year;
- place the organization on probation for a specific period of time;
- place the organization on suspension for a specific period of time; or
- cancel registration of the organization permanently.
A registered student organization is entitled to appeal the decision of the Committee on Student Organizations to the President. The organization appeals by giving written notice to the Vice President for Student Affairs with a copy to the Chair of the Committee on or before the fifth day after the day the Committee on Student Organizations announces its decision. The appeal is informal but shall contain the organization's name and mailing address, a description of each violation of which the organization was found guilty, the date of the Committee's decision, a copy of the Committee's findings of fact and assessed penalty, and pertinent supporting documents. Notice of appeal given under this subsection suspends imposition of any penalty until the President renders a decision on the appeal.
