It is the intent of the National Park Service (NPS) to establish a Cooperative Agreement with the
Journey Through Hallowed Ground National Heritage Area (JTHG). The purpose of the Agreement is to:
(1) recognize the national importance of the natural and cultural legacies of the area, as demonstrated in the study S. 2739?50 entitled ??The Journey Through Hallowed Ground National Heritage Area Feasibility Study?? dated September 2006;
(2) preserve, support, conserve, and interpret the legacy of the American history created along the National Heritage Area;
(3) promote heritage, cultural and recreational tourism and to develop educational and cultural programs for visitors and the general public;
(4) recognize and interpret important events and geographic locations representing key developments in the creation of America, including Native American, Colonial American, European American, and African American heritage;
(5) recognize and interpret the effect of the Civil War on the civilian population of the National Heritage Area during the war and post-war reconstruction period;
(6) enhance a cooperative management framework to assist the Commonwealth of Virginia, the State of Maryland, the Commonwealth of Pennsylvania, the State of West Virginia, and their units of local government, the private sector, and citizens residing in the National Heritage Area in conserving, supporting, enhancing, and interpreting the significant historic, cultural and recreational sites in the National Heritage Area; and
(7) provide appropriate linkages among units of the National Park System within and surrounding the National Heritage Area, to protect, enhance, and interpret resources outside of park boundaries.
Competition is not relevant to this agreement. Public Law 110-229, which established the Journey Through Hallowed Ground National Heritage Area, specified that the Journey Through Hallowed Ground Partnership shall be the local coordinating entity for the Heritage Area. The law further directed and authorized the Secretary to enter into a cooperative agreement with the local coordinating entity and other public or private entities to assist in conserving the significant natural, historical, cultural, and scenic resources of the Heritage Area; and providing educational, interpretive, and recreational opportunities consistent with the purposes of the Heritage Area and participate in the development and approval of the Management Plan.
Public Law 109-338 created the JTHG in 2008 and authorized the Secretary of the Interior (hereinafter referred to as "the Secretary") to enter into an agreement with the Journey Through Hallowed Ground Partnership, pursuant to which the Secretary shall provide assistance to the Partnership.
16 U.S.C. ? 1g authorizes the NPS to enter into cooperative agreements that involve the transfer of NPS-appropriated funds to State, county and local governments, other public entities, educational institutions, and private non-profit organizations for the public purpose of carrying out NPS programs.
P.L. 110-229, Sec. 404(a)(6) Authorities: The Secretary may, upon the request of the local coordinating entity, provide technical assistance on a reimbursable or non-reimbursable basis and financial assistance to the Heritage Area to develop and implement the approved management plan. The Secretary is authorized to enter into cooperative agreements with the local coordinating entity and other public or private entities for this purpose.
