UTA's Response To
Sexual & Relationship Violence On Campus
UTA Violence Policy | Victim's
Bill of Rights | Disciplinary Hearing Rights
Mission:
The
Relationship Violence and Sexual Assault Prevention (RVSP) Program is
committed to creating and maintaining an environment in which all members of
the University Community can persevere academically, personally and
professionally in an equitable and safe manner, devoid of sexual and
relationship violence. These goals
are achieved through education and awareness of sexual and relationship
violence, implementing programs and services that meet the diverse
educational, personal, and safety needs of students on campus, and
constructing a program whose foundation is based upon support and advocacy
for students impacted by sexual and/or relationship violence. It is the hope
of the RVSP Program that students will feel empowered to disclose incidents
of sexual and relationship violence and to seek assistance through the
healing process.
UTA
Campus Sexual and Relationship Violence Policy
The
University of Texas at Arlington (UTA) is committed to creating and
maintaining an educational environment in which all persons who participate
in University programs and activities can work together in an atmosphere free
of sexual and relationship violence. Sexual assault, dating violence, and
stalking offenses, regardless of the motive or the manner in which they are
executed, are criminal behaviors and produce an environment that opposes the
objectives, goals, and mission of this University.
The University
of Texas at Arlington prohibits and will not tolerate any act of sexual or
relationship violence including rape or attempted rape, acquaintance/date
rape, or any other forms of non-consensual sexual activity, harassment,
assault, abuse, exploitation, intimidation or threats of future violence to
oneself, one's family or friends, or one's property on this campus. For
purposes of this Policy, "campus" includes any property that UTA
owns or leases, any off campus site or facility that is maintained by the
University, or on grounds or facilities maintained by a student organization
or any other area that the University has permission to occupy for the
purposes of conducting a University sponsored program.
Every member
of the University community, whether they are a student, faculty, staff,
administrator, visitor, invitee of the University of Texas at Arlington or
participant in a UTA sponsored program should be aware that the University
does not tolerate sexual or relationship violence. Sexual Violence/Assault is
also prohibited by Federal law, by State Law as listed in the Texas Penal
Code Section §22.011. (Sexual assault) and §22.021 (Aggravated sexual
assault), as is Relationship Violence (Texas Family Code (Section 71.0021)
and Stalking (Sec. 42.072.) as well as by the UTA Student Conduct Code found
in the UTA Handbook of Operating Procedures.
It is the
intention of the University to take prompt action and swiftly investigate all
alleged acts of sexual violence. Those who violate these sexual assault
policies and protocols are subject to all applicable punishments, including
student and employee disciplinary procedures and/or all related criminal
procedures. This University shall maintain the identity of any alleged victim
or witness of a sexual assault on University property in confidence unless
the victim/survivor has waived their right to confidentiality.

UTA
Sexual and Relationship Violence Victim's Bill of Rights
It is the
right of a Sexual Assault, Relationship Violence, or Stalking Victim at UTA
who reports their experience to University officials to anticipate that:
- Victims will be treated with
dignity and respect and in a non-judgmental manner
- All sexual and relationship
violence cases will be treated seriously.
- All campus organizations and
services that can assist victims will be identified
- The will confidentially
receive the full array of support services at UTA
- Victims will receive prompt
assistance from UTA personnel in notifying and dealing with the proper
authorities
- University officials will
inform students of their option to notify appropriate law enforcement
authorities, including on-campus and local police, and offer assistance
in notifying proper authorities when an individual discloses an incident
of sexual assault.
- Victims will be free from any
pressure from UTA Personnel about whether to report crimes to the police
or to UTA authorities and how they should respond to such charges
- University personnel will not
discourage victims from reporting, nor encourage them to under-report or
report the incident as a lesser crime.
- University personnel will
cooperate in obtaining, securing and maintaining evidence (including a
medical examination), necessary in legal proceedings.
- Individuals will be notified
of available on and off-campus counseling, mental health, and
psychological services, or other student services for those reporting
sex offenses.
- Individuals will be afforded
the opportunity to request immediate on-campus housing relocation,
transfer of classes, or other steps to prevent unnecessary or unwanted
contact or proximity to an alleged perpetrator when reasonably available

Disciplinary
Hearing Rights of Sexual and Relationship Violence Victims
- The sexual or relationship
violence victim may request that reasonable accommodations be made in
hearing procedures, such as special seating arrangements in the hearing
room.
- Victims may invite an advisor
or advocate they choose to accompany them through University
disciplinary proceedings.
- A victim will be notified of
the outcome of related University discipline proceedings. The victim and
the charged student must respect the privacy of all involved.
- The sexual history of the
victim is not considered relevant to the truth of the allegation;
therefore, the victim has the right not to have his or her sexual
history discussed during the hearing.
- The victim has a right to
make an "impact statement"
All students have
the right to an environment free from sexual or physical intimidation, or any
continuing disruptive behavior, by persons sharing rooms or their guests,
that would prevent a reasonable person from attaining their educational
goals. Disruptive behavior of this nature should be reported to appropriate
University staff, so it can be addressed immediately
