Section 3-701 Membership
There shall be elected from the faculty in the manner described for elections to the Undergraduate Assembly (Sec. 3-505) members to serve on the Faculty Hearing Panel. The Membership of the Faculty Hearing Panel shall be equal in number to the elected members of the Undergraduate Assembly plus at least one and no more than three members from each graduate or professional school. The term limit on successive terms, basis of apportioning members to electoral units, and election procedure shall be the same as for the Undergraduate Assembly.
Only tenured members of the faculty are eligible for membership on the Faculty Hearing Panel. A dean, a vice president, the Provost, and the President, are not eligible for election to the Faculty Hearing Panel.
Section 3-702 Hearing Committee
A Hearing Committee shall consist of at least three and no more than five members appointed by the President from the standing Faculty Hearing Panel. At least one of the Hearing Tribunal members will be selected from that portion of the standing panel selected through faculty input. The Hearing Committee shall elect its own chair. At least two alternates shall be appointed to serve in the event a member of the Hearing Tribunal determines that he/she cannot serve with impartiality. If vacancies occur, they shall be filled from the alternate list. If the alternate list is exhausted, the President shall appoint replacement(s) from the Hearing Panel. A challenged member excused from a particular case shall return to the panel for the hearing of subsequent cases. Members of the Hearing Committee shall follow the procedures specified in Series 31008 of the Rules and Regulations of the Board of Regents of The University of Texas System.
The Hearing Committee shall hear those cases involving the termination of employment for cause of a tenured faculty member or a non-tenured faculty member during the term of his/her appointment in accordance with the provisions of Series 31008 of the Rules and Regulations of the Board of Regents of The University of Texas System. The members of the committee shall also hear cases in which a nontenured faculty member alleges that the nonrenewal of his/her appointment was based upon his/her exercise of rights guaranteed by the Constitution or laws of this State or the United States and has submitted in writing to the President factual allegations to support the allegations in accordance with the provisions of Series 31008 of the Rules and Regulations of the Board of Regents of The University of Texas System.
