Remarks FAILED - There is no implied contract; the parking guide states that a parking spot for everyone is not guaranteed.
Whereas There is an insufficient number of parking spaces to provide an A-lot parking space for all students with an A-lot parking sticker; and
Whereas The parking office makes parking available to students as a service via an implied contract. Students participate in this implied contract by the purchase of a parking sticker. The University of Texas at Arlington becomes responsible for providing sufficient parking to all A-lot students by the acceptance of a parking lot fee; and
Whereas The University of Texas at Arlington breaches its implied contract by failing to provide parking spaces to all of the students who purchase an A-lot sticker; and
Whereas This breach in implied contract can potentially result in a class action suit; and
Whereas Student Congress has proposed five resolutions intended to make more parking available with no avail.
Be It Further Resolved That The parking office will be responsible for the installation and maintenance of a fair and equitable policy. This new policy will provide a sufficient number of A-lot parking spaces to all students which purchase an A-lot sticker; and
Be It Further Resolved That Student Congress and the student body will suggest programs and provide student input. Student Congress' proposals will include, but will not be limited to: 1) Three student A-lots (numbers 37, 42, and 48) will be converted into faculty lots. Students will be randomly assigned to A-parking, faculty parking, or remote parking. The number of students which are awarded faculty parking will be equal to the spaces made available by the conversion of lots 37, 42, and 48. 2) Students may elect to park in remote parking in lieu of paying a parking ticket. This will cause a net transfer of students from A parking to remote parking. The students will not be reimbursed for the difference between the two parking fees. The discrepency between fees will compensate the parking department for the unpaid tickets. 3) A-lot parking stickers will be made available on a first-come first-serve basis. The parking office will limit the amount of A-lot parking stickers sold to students. The parking office will continue to reduce the number of parking stickers by 10% each semester until all students which purchase an A-lot sticker are provided an A-lot parking space. 4) The student body shall purchase a new parking garage by collecting a self-imposed fee; Further: The parking office will be included in the discussion of the solutions proposed by Student Congress and the student body. Failure to participate in the discussion (even by letter or phone) will be considered an act of bad faith; and
Be It Further Resolved That The student body will serve as the sole arbitrator of a fair and equitable policy. All policies which are jointly approved by Student Congress and the parking office will be placed on a student referendum. Students will be able to vote for one of the proposed policies, a combination of the policies, or the current state of affairs. The option which recieves the most votes will be enacted by the parking office; and
Be It Further Resolved That Student Congress and the parking office will continually enact new policies until all students can participate in the parking service they paid for; and
Be It Further Resolved That This bill does not place blame upon the parking office for the state of affairs. It obligates the parking office to fulfill their implied contract. The bill simply intends to provide the students with the service they paid for.
